How utterly petty of the club.

Hopefully he''ll just change the name, however ridiculous it may be that he has to do so. It''s a nice pint!

This is very disappointing of the club I think, how can the club claim to own ''On the Ball''?! I guess this is the downside of the new tough, strong board we have. Great when its standing firm on keeping players and managers, but this is an unfortunate downside of their tough approach to all things Norwich City. All seems very unneccessary tho, no way any customer would think that the drink would be directly affiliated with the club

Guess it may be connected with the OTBC on the shirt collar....anything that raises revenue now we''re in the premier league will probably be jealously guarded by the club

 

That said its a shame the club couldnt have come up with some sort of partnership agreement....it would have been good publicity

If it is registered as a trade mark, then yes. A trade mark is a brand. which curiously is defined as such -

"A brand is a ''promise of an experience'' and conveys to consumers a certain assurance as to the nature of the product or service they will receive"

A certain assurance, eh ?

This is pretty much what is has become. For all the pious tosh about it being a family club with strong local roots we are beholden to the large corporations.

Turn that definition on it''s head and it explains the corporations role in all this whereby '' a brand delivers a large group of passive consumers to your products (the experience). Homogenised sh!te, in reality.

"A crowd is a ''promise of a consumption'' and conveys to suppliers a certain assurance as to the nature of the compliance or acceptence they will render"

Yes - saw this on another forum.Not very " community - minded" of our family club.A poor show from the club - but hey, there''s no such thing as bad publicity - I''ve just checked the guy''s website, and am looking to pick up a few bottles of "Chocolate Nutter" when I''m down next!!!

"[/quote]You should get shares for that idea [Y]Does seem petty to me but we can''t have a business-focused hard nosed club and a community friendly club and this is far from "little old Norwich".  If I had to choose then sorry Mr. Brewer, but I''m with the club.

I would have thought that it comes down to whomever owns the rights to the song. If that is the club then it''s fair enough, although I do think the club could be a bit less aggressive. As for McNally? Well that''s what he''s paid for. Character assassination is uncalled for.

Whether he is paid for it or not is another matter entirely. However community figures such as this man trying to make a living in these hard times should be celebrated not destroyed by a flick of the button by the above the all so powerful.

[/quote]The street vendors are careful not to use the club crest etc so they get away with it.I can''t speak for the club but would imagine they were more against the crest being used than "On the Ball". I can see where they are coming from, having "On the Ball" and the clubs crest on the label makes it looks as if it''s an "Official" club beer and they don''t want to be associated with it, Why Not Brewery were in the wrong using the clubs crest without permission in the first place, if they had released the beer with say a green label with On the Ball in yellow the club would probably have let it go.

Very tough move from the club but then again I''d rather have the club in its current state than what it was like before!

Surely the club could sort out a deal with the brewery like a one off fee then a % of profits?

I''d of thought it would help the club to have something linked to the club on a local brew cause it helps keeps the clubs name in the limelight!

How about "On the ale City!" surely the club haven''t trademarked that!!! :)

It''s a little bit embarrassing that the club treats it''s fans like that,

but I guess they feel the need to act tough to avoid people standing up

to them. I''d have thought dropping the use of the emblem (which does

seem wrong), but still using "On the ball" would be fair.

It''s disappointing, but probably to be expected from any medium to large

sized company... which is what it is these day... it''s not a "community

club", it''s a profit driven business - certainly in the eyes of those

running it... and probably for the better really.

To be fair though, the club does retain community values, which is

commendable, but it certainly doesn''t belong to the community.

Can''t see what the furor is about. "Passing off" is a quite clear aspect of English tort law, if you pass off your item as something it isn''t, you''re liable to legal action. By using the club''s crest, green and yellow colouring and the words "on the ball" which is three of four words heavily associated with the club, you''re assuming rights over another''s brand. I think it''s right, proper and not petty at all that they put a stop to it.

Googler the problem is as a country we are suffering massively from the lack of our own industries. With this mans entrepreneurial invention he has thought of a way to make money and could potentially provide people with jobs. This is the way to sort out the economy, the fact in this country the big boys stop any form of entrepreneurial state of thought is ludicris and it''s no surprise we find ourselfs with mass unemployment and increasing debts.

I''m all for someone trying to make money, but not by taking someone else''s property.

Was that a serious response? "Entrepreneurial invention?" What this person has done is created a beer by using an already proven method of brewing beer, changed the recipe slightly and slapped NCFC labels all over it trying to promote it to a well established market. He then furthered this by using the clubs badge with no prior consent and it''s tag line. I think it is a massive insult to the club and cannot for a minute comprehend that people think this isn''t the way for the club to behave.I have just had a wave of entrepreneurial invention. I''m going to repackage some condoms with a black case, a white swooshy logo and the tag line "Just Do It" Good bit of entrepreneurial invention in these tough economic times. Hope I make some money!

However, Woodfordes also have a beer using a green and yellow label with

a canary to celebrate promotion, so are the club going to threaten them

too?Norwich City could have just asked the fan to remove the club badge and left it at that. Nobody would have any complaints with that demand. Asking him to remove the name and colours (that the club don''t own) is over the top.

Jayncfc your use of Nike is a illegitimate case. The point is NCFC is something for the community of Norwich they should be encouraging the community to be firstly promoting the club and also helping themselves to a better life. Nike doesn''t care about communities and they stamp all over anyone to make a profit, this is well known however i don''t feel Norwich have to be following Nike''s way of business what next we shall be shipping in ballboys from cambodia?

Have you thought that the club negotiated with the brewery concerned?

Maybe Woodforde''s have signed some sort of deal to be able to market it like this?

However on the woodforde''s label there is nothing to say norwich city or the norwich city canary which is on the badge it is only a cartoon one which the club cannot stop.

The website which you quoted doesnt actually contain the club logo anywhere on there which I can see.

The words unofficial also appear all over the site and maybe permission was gained for use of the words "on the ball city" as required.

I think the debacle is more getting at the use of the club''s logo rather than the words on the ball city.

It is also a little bit more than a home-brew with him selling to various shops such as jarrold''s and going to farmer''s markets to sell his beers.
