A civil case would be determined on the balance of probabilities, ie on balance is it more or less than 50% likely that he intended to do it. If he said he didn't mean to do it, a lot would depend on how believable his testimony was. I don't think the EFL not looking at it would help him because that's down to the way the EFL rules work, it doesn't mean they think he's done nothing wrong.
